Well done Jason. I have received a few emails within the past couple days from people asking what they can do to help and contribute. I hope to receive more emails like this. I have asked these individuals if they are currently BAA members and if they aren't to really consider joining.

I think we should tell folks "we may" have to pull because they are saying we are infringing on there copyrighted material.
Let the Bowfisher answer the people when they start asking how. That way we don't appear to be hiding anything from anyone.

The fact of the matter is Dan and penny won't tell us what they feel is copyrighted, but they are threatening the Baa with legal action if the Baa does not pull the e-journal down. They maybe able to ignore our request but there not going to be able to ignore the public. And honestly I think the people need to know who there dealing with.

Then again they made personal accusations towards me on this so I may be partial

I totally agree with Mike, I think the sooner the better. If we let them go first they will have the chance to spin things in their direction and thats not what we want.

I say put it out there just like Mike is suggesting, then they will have to make excuses and explain things to their readers and all the members here. This will keep things in our court and benifit us in the long run.

I think we need to get something out asap.

I've since spoke with Jason, Mark, DC, Mark, DC, and Mark again. And I need to call Jason..... again


When DC was speaking to Penny, he let the cat out of the BAG that we were about to take the whole thing public and he also told her the E Journal probably looks similar to there digital version because we now know we are using the same hosting site for the two publications.

He said her tone immediately changed and asked if we would take a week to cool off before doing anything rash ( like taking this public ) DC said there has to be someway to work this out civilly, and her response was how about you only send it out to your members and keep it out of the public. DC of course said I'll get back to you and called Mark and Myself to ask our opinions on the matter.
During that time Jason discovered that not only did they send out that email to there pro staff and writers but also to ALL THEIR ADVERTISERS stating the BAA was violating there copyrights. ( can anyone here say Slander! :shocked

Now Mark and DC had thought it would be a good gesture to give them there week but after hearing the news that they are out there mass emailing manufacturers that the BAA deals with and relies on for donations, support etc. They have since changed there minds and think it would be best to get this out there as soon as possible. After hearing what they have done everyone is wondering why we are even trying to comprise with them at all.


My feelings on the matter is............. I am flat out pissed! That they would send out mass emails like that manufacturers trying to make it look like the BAA is doing something illegal, knowing damn well they don't own the rights to produce a bowfishing publication and knowing damn well they don't "own" exclusive rights to writers content unless they have a contract with that writer.


This whole thing just got a lot deeper and much more ugly

Well I hope you all enjoyed it because as of Monday Mark Lee received an email from Penny and Dan at the The Bowfisher that stated they have spoken with there attorney and are claiming there is copyright infrigments with the journal and the Bowfisher. Monday evening Mark asked for clarification on what maybe copyrighted as we(BAA) were under the assumption that all the articles and photos submitted to the journal were owned by the members that sent them in. But, we would be glad to remove them until the legalities of these issues could be resolved.
Their response was there are copyright issues and want the journal taken off all the sites it's posted on, including face book or there attorney will contact those server sites and have them shut down.


So since the Bowfisher will not clarify on what might be a copyright issue so we can address the problem, we may be forced to remove the E journal. We'll see.

I would also like to add that at no time did we knowingly violate any copyrights. All photos and articles were submitted by there perspective owners, other than some ads which were designed by Baa members for supporting Baa companies or submitted by those companies that owned them.
And the flip page layout design is an issuu template not something we made. And for those of you not familiar with issuu, it's a free publication hosting site(similar to YouTube but with publications). If that happens to be who they use for their online version of the bowfisher? Well that could explain why they look the same, but the reality of that is, we don't own that flip format and neither do they, Issuu does.
So if we can find out exactly what the copyright is( if any) so we can take care of it, we may be forced to pull it.
We will see.
