I have a size HP Question

Ok I have a 1985 16 52 polar kraft Jon boat the plate on the boat has it listed for a Max HP of 35 well I just bought a 40 HP 1986 evinrude to put on it because with my deck, generator, and 3 people the 20 merc was just not cutting it I was goin an extremly fast 12 miles an hour..... ADD a couple fish to that and you start goin a really quick 9 or 10 mph. So with the bigger motor i thought it would increase my speed and still be enough since im swithcing from halogens to HPS with the added weight of my ballast. My Dads concern is that I will get into Trouble for having a larger motor than what im susposed to because I have heard if you take your boat to the beach then the coast guard will right you a nice ticket. Basically just wondering how much trouble i will get in and with who ???? my other question is if i put float pods on my boat does that allow my Max HP to go up and does that make your boat a custom rig?

To my knowledge the coast guard hp ratings are not enforced by federal law. However many states use the boat's coast guard rating as law. You'd be more likely to get in trouble with state/local marine police or game and fish. Check your state regs.

But like said above pull the stickers and most likely no worries.

Federal regs do not address HP ratings except to boat manufacturer. Fed regs point to state law, so it depends on your state regulations & laws. Do a google search. Our Alabama regs point back to Fed regs, so AL has no HP rating laws. This was confirmed by AL Marine Police when I tried to get mine rerated. They are more concerned with weight limits including the add'l weight of larger motor!

I think you will be fine.....Only boats I have ever known to be checked for the hp were grossly overpowered. Ones that you could look at and say without a doubt they had WAY to big of motor.......I also knew a guy that fished bass tournaments. He had a 250 on his boat, but had 150 decals on it. No one ever questioned it.
